Whether an international divorce case can be processed in the German judicial system depends on the residence of the spouses, citizenship, and the status of the case in a foreign country. In fact, the Brussels IIb Regulation provides a general set of rules concerning jurisdiction in divorce, separation, annulment of marriage, and parental responsibilities within the European Union.
Just because the German court has jurisdiction over a particular case does not mean that German divorce legislation will automatically apply. Thus, the Rome III Regulation provides rules of conflict applicable to the EU member countries and gives them some limited power to choose the applicable law if the conditions of the regulation are satisfied.
In cases of divorce where the parties reside in different countries, the concept of habitual residence of the child involved often comes into play. Furthermore, prior judgments of other courts, EU law, and international conventions might have to be taken into account.
If the child has gone to a country or is being held there unwillingly, the Hague Convention Customary Law may come into play. Normally, the process will not consider who should have the child in their custody, but rather if the child must return to the previous country or not.
In situations where the person entitled to support and the person obliged to pay for the support live in separate countries, claims for support may need to be established and enforced, depending on the countries concerned.
